What is INCLUDED in our Legal Fees for:


PURCHASE OF A HOME OR CONDOMINIUM

  • review your Agreement of Purchase & Sale (including all Waivers & Amendments provided to us), if we detect issues or problems we will recommend Amendments for your benefit;
  • review all Resale and New Build Agreements;
  • review of the Status Certificate & Certificate of Insurance when you purchase a condominium;
  • arranging Title Insurance on your behalf, this includes Preparing All Relevant Documentation, and Reporting to the Title Insurer After Closing;
  • prepare, if you are an eligible first time home buyer, including all required Affidavits to arrange for your Land Transfer Tax Refund for both Toronto & Ontario, all in compliance with the Land Transfer Tax Act;
  • review the Mortgage Statement & Verify that the Mortgage you assume is in good standing (if applicable);
  • review & submit to Requisitions on Title and Review Responses & Reply to such when necessary;
  • conduct One Title Searches & other necessary Searches (e.g. property taxes, executions, etc.)
  • prepare a Statutory Declaration stating that you are not one and the same person as any Execution Debtors with similar names, when in fact you are not the same person;
  • review all new build documentation, including verifying enrollment with Tarion Warranty Corporation, Declarations, Undertakings, etc.;
  • prepare all documentation necessary to complete your Transaction (e.g. Purchase, Mortgage, Transfer of Title, etc.);
  • Prepare & Register your Transfer/Deed of Land;
  • Prepare & Register your Mortgage/Charge;
  • preparation and certification of up one cheque and/or bank draft;
  • examine the Draft/Transfer Deed;
  • review the Statement of Adjustments on a Purchase
  • prepare Undertakings, Direction for Funds and other documents required to complete your transaction;
  • registration of ONE Conventional Institutional Mortgage or ONE Secured Line of Credit
  • co-ordinate the Receipt & Distribution of Closing Funds;
  • Manage the Closing of your Transaction;
  • take care of all the telephone & written communications necessary to close your transaction;
  • prepare & submit a Mortgage Report to each of your Lenders (if there is a lender/mortgagor);
  • digitally archive on your behalf, your Real Estate Transaction’s documentation just in case and for your peace of mind, for a period of time that may exceed the Law Society of Upper Canada’s requirements for file retention;
  • provide Answers to all your Questions regarding your transaction for no extra charge;
  • prepare a complete Closing Package for your Real Estate Transaction for you;
  • meet with you in person to Sign and Execute all documentation necessary to complete your transaction;
  • includes ALL internal disbursements (i.e. fax, postage, copier, scans, phone calls, storage fees)

SALE OF A HOME OR CONDOMINIUM

  • respond to Requisitions on Title and Review Responses & Reply to such when necessary;
  • prepare a Statutory Declaration stating that you are not one and the same person as any Execution Debtors with similar names, when in fact you are not the same person;
  • prepare all documentation necessary to complete your Transaction (e.g. Sale, Discharge of Mortgage, Spousal Consent to Sell, etc.);
  • prepare a Calculations Report of all the Closing Statement of Adjustments for pre-paid items (i.e. property taxes, etc.);
  • create a Statement of Adjustment on a Sale;
  • discharge of ONE Conventional Institutional Mortgage or ONE Secured Line of Credit
  • pay the Law Society of Upper Canada Real Estate Transaction Levy Fees for your Sale transaction;
  • payment from the Proceeds of Sale, the Balance of any Real Estate Commissions Owing;
  • take care of all the telephone & written communications necessary to close your transaction;
  • digitally archive on your behalf, your Real Estate Transaction’s documentation just in case and for your peace of mind, for a period of time that may exceed the Law Society of Upper Canada’s requirements for file retention;
  • provide Answers to all your Questions regarding your transaction for no extra charge;
  • prepare a complete Closing Package for your Real Estate Transaction for you;
  • meet with you in person to Sign and Execute all documentation necessary to complete your transaction;
  • includes ALL internal disbursements (i.e. fax, postage, copier, scans, phone calls, storage fees

What is NOT INCLUDED in our Legal Fees:

  • any items not outlined above;
  • any additional items to the above;
  • any changes in instructions;
  • any interim occupancy costs and/or interim closing costs
  • applicable courier fees;
  • additional banking charges;
  • payouts of any credit cards or other debts;
  • registration and/or discharge of any Mortgages or Secured Lines of Credits in addition to the above;
  • applicable Law Society of Upper Canada fees;
  • Title Insurance Fees
  • Land Transfer Tax
  • Harmonized Sales Tax
  • Electronic Mortgage Processing fee (if applicable)
  • Searches of Title and Searches of Executions
  • Government Registration Fees
  • Additional charges apply to Investment Properties, Commercial Properties and/or Bridge loans.
